Defected Records LTD are organizing a competition with no obligation to buy, called" WIN A TRIP TO IBIZA!

Article II: Dates of the operation

This contest is held at sharemyplaylists.com available at the URL (*sharemyplaylists landing page URL here) (hereinafter referred together to as “sharemyplaylists”) from 12.00am Friday 29.06.12 – 11.59pm on 31.08.12 11.59pm

Any entries after this date and time will not be considered.

Article III: Participants

The contest is open to any individual person who lives within participating territories  of United Kingdom, France, Belgium, Netherlands, Spain, Germany, Austria, Norway, Finland, Sweden & Denamrk (hereafter refered to as “participating territories”) & has an active Spotify account (hereafter the “Participant”).

Participants must be over 18 Years of Age.

All people working for Companies involved in the organization of the competiton (Spotfiy Ltd, Warner Music Limited, Alternative Distribution Alliance, Sharemyplaylists & Defected Records), as well as their advisers and family members, are excluded from any participation in the Contest.

Article IV: Participation rules

In order to win the competition, participants must successfully upload an active Spotify playlist to sharemyplaylists (LANDING PAGE URL HERE).

Entries must be listed using Defected Playlist genre listing provided at the point of submission.
Only 1 entry will be accepted per person for this competition. Where multiple entries are submitted by 1 user, only the entry with the most active subscribers on their individual Spotify user profile on 1st September 2012 at 12.00pm will be accepted.
Defected Records does not accept any responsibility for late or lost entries.

Defected Records shall not be held responsible for any inability to submit entries as a result of computer service, systems and or server failure, error, interruption, defect or delay or any other technical malfunction. Proof of sending is not proof of receipt.

Deeming an entry void is at Defected Records absolute discretion

Participation in the Contest covered by these Rules, terms and conditions is free of charge.

Participation in the Contest is subject to acceptance of these Rules, terms and conditions.

Entrants will be deemed to have accepted these rules and to agree to be bound by them when entering this competition.

This competition and the rules of the competition are governed by the laws of England and Wales. This competition is void where these Terms & Conditions are prohibited by local law.

Article V: Naming of winner and prizes

There is 1 winning prize.

The Winner of the contest will be the user with the most active subscribers to their playlist entry on their active Spotify user profile on 1st September 2012 at 12.00pm.

The winner will receive two complimentary Economy return flights from an airport within the participating territories, ground transfers in Ibiza between the airport and hotel on arrival and departure, (x star) hotel accommodation for 2 people for two nights, 2 complimentary tickets to Defected In The House @ Pacha, Ibiza on 29th September 2012 and booking of a table for (x) number of persons at the Café Mambo pre-party on 29th September 2012 including complimentary food and drink for two persons.  No other expenses will be covered in the prize, transfers in the winners home country will not be covered.

The winner will be announced on the competition web site (URL ---------------------------------------------------) on 03rd Sept 2012.

The winner will also be notified separately by email from Spotify. The email will include information on how to claim the prize.

Article VI: Obligations of Winner of the Contest “WIN A TRIP TO IBIZA”

Winner status is not transferrable and cannot be reimbursed in cash or any counterpart of any kind.

article VII: force majeure

The organizer reserves the right to shorten, extend, change or cancel the Contest.

It may not be held liable for making any of these changes.

Article VIII: Responsibilities

It is expressly recalled that the Internet is not a securitized network.

The Company thus cannot be held liable for contamination by any viruses or the intrusion of third parties into the terminal, computer system of the Contest participants, and declines any responsibility for the consequences of the participants’ connections.

The Company declines any responsibility in the event of malfunction of its Internet network, in particular due to such malicious external deeds, which might hamper proper Contest proceedings.

More particularly, the Company could not be held responsible for any damages caused to the participants, to their computer hardware or to the data stored on it, or for any consequences to their personal or professional activities.

The Company’s responsibility may not be engaged either in the event of routing problems or loss of letters or e-mails.

Nor can the Company be held responsible if one or more participants cannot connect to the Artists’ Official Channel, or cannot participate in the Contest due to any technical problem or defect stemming in particular from network bandwidth.

The Company’s responsibility cannot be retained either in the event of technical problems related to the various platforms.

The Company reserves the possibility to interrupt access to the Artists’ Official Channel and to the Contest it contains at any time, and in particular for technical reasons, for updates and for maintenance.

The Company declines any responsibility in the event of an incident that may occur during participation in the Contest and subsequent to it.

The Company cannot be held responsible for any incident or accident that occurs during the routing of the Winner, or the person accompanying the Winner to the concert site.

Any untruthful or deceitful declaration or any fraudulent activity disqualifies the Participant.

Any difficulty in interpreting or executing the Contest or its Rules shall be settled by the Company, whose decisions cannot be appealed.

No phone, electronic mail or written requests, or requests sent via social media and other online platforms, shall be answered concerning the interpretation or application of these rules or the Contest mechanisms, procedures or the Winning entrant?

Lastly, the Company may not be held responsible for any fraudulent use of connection rights or awarding of prizes of a participant, unless serious wrongdoing on the part of the Company can be proven.

Article IX: Rules

Participation in the Contest implies acceptance of the Contest Rules, Terms & Conditions in full and without reservation.

The rules, terms & conditions may be changed at any time by an addendum by the Company under the stated terms published online as announced on the Artists’ Official Channel.

Article X: Disputes

Any dispute or claim relative to this contest must be made in writing and sent to the address given in article 1, and cannot be taken into consideration later than one month after closure of the contest.

 

Article XI: Personal data

The data collected is processed by computer.

It is used by the Company, as the case may be, for any direct marketing operation via any media, conducted by the Company to inform its customers of news and events.

Under the Electronic files and freedoms Act of 6 January 1978, modified by the act of 6 August 2004, the Participant has a right to access and a right to further information, rectification and, as the case may be, opposition to the data concerning him or her.

He may oppose its communication to third parties at any time.

Article XII: Intellectual property

Any reproduction or representation, of all or part of the elements making up this contest is strictly forbidden.

Article XIII: Attribution of jurisdiction

Participants are subject to English regulations applicable to contests. In case of dispute, the parties shall endeavor to settle amicably. Any dispute that cannot be settled amicably shall be submitted to the competent London Courts

ARTICLE XIV: DATA PROTECTION POLICY

Defected takes the privacy of its customers very seriously, and will only collect information in order to facilitate competitions and (if requested by the customer) to provide information via our e-mail new release lists. We never send unsolicited e-mails to customers, and we do not sell mailing lists or customer information to any other companies or individuals.
